2014 changes to Pennsylvania's Power of Attorney Law

New Pennsylvania Power of Attorney Law By Todd Allen Elliott, Esquire. On July 2, 2014, Governor Corbett signed a new Pennsylvania Power of Attorney bill into law. That law, Act 95 of 2014, makes several significant changes to Pennsylvania's Power of Attorney law. Among other things, the new law requires the following of Powers of Attorney executed in Pennsylvania: The Notice section of the Power of Attorney has been revised with new language; The Agent's Acknowledgement has also been revised to more clearly delineate the agent's duties and responsibilities; At least two witnesses who are over 18 years of age must now witness Powers of Attorney; Powers of Attorney must now be notarized. If you have a Power of Attorney that was drawn up prior to the new law's effective date (some provisions went into effect immediately and others became effective on January 1, 2015), you should review it with your lawyer to make sure it complies with the new law. Generally, if your estate planning documents (Will, Power of Attorney, Advance Healthcare Directive, etc.) are more than five years old, you should review them all to make sure they still do what you want them to and to make sure they conform to today's laws.
